These are the Terms & Conditions for using this site, our services and our products. If you have any questions regarding these T&C's please contact us.

Note - For the purpose of this document the visitor to the site or the individual (whether representing an organisation or not) who orders an image shall be referred to as the Client.

Note - No variation of the terms and conditions set out here will be effective unless agreed in writing by both parties. In the event of any conflict between these terms and conditions (including those relating to the time of payment) and those issued or submitted by the Client and in the absence of any contrary agreement in writing these Terms and Conditions shall prevail

1. Ownership of this website
   This Web site is owned and operated by Island Photographic Services. All of the Content featured or displayed on this Web site, including, but not limited to, text, graphics, images, illustrations and software ("Content"), is owned or distributed by Island Photographic Services; photographic copyrights are owned by the photographer credited for each image. For the protection of the content on this website, we may elect to digitally watermark any and all images without prior notice.

2. Your use of the content
   Until you obtain a license and/or written permission from Island Photographic Services to use any image or text content, you may not download, reproduce, distribute, transmit, or otherwise exploit the content in any way except as described in the permitted usage below. Your use will be limited to the scope of the license agreement and/or the written permission from the copyright holder. No illegal use is ever permitted. All elements of the Island Photographic Services website, including, but not limited to, the general design and the Content, are protected by copyright, trademark and other laws relating to intellectual property rights.

3. Copyright www.Manxinfocus.com retain full, unlimited, world-wide copyright on all photographs supplied. These photographs are solely for personal display purposes. They may not be copied, published, reproduced, or stored on any electronic retrieval system without the express written permission of Island Photographic Services.

4. Match to original (Likeness to person/colour)
   In accordance with the accepted practises of all professional photographers and photographic laboratories, the return of any technically acceptable photographs or prints or demands for refund or refusal to settle charges cannot be entertained on principle. No exception whatsoever can be made to this rule as we cannot be held responsible for individual tastes or expectations.
   Note all images displayed on this site conform to a 3x2 format, sizes not conforming to this ratio i.e 7x5 will be cropped and some protion of the image will be lost. Prints supplied will be borderless, printing will extend to the edge. Borders can be added for mounting purposes but this must be stated when ordering. Include size of border required.

5. Failure
   Whilst every care is taken at every stage of the photographic process, in the event of a camera failure, operator error, material failure, or process machine failure, Island Photographic Services can accept no responsibility for any losses however incurred as a result of any such failure beyond a full refund of the original purchase price.

6. Permanence
   All photographs supplied by Island Photographic Services are produced to the highest standards using the best quality materials and latest processing techniques. We guarantee all prints ordered from this site will be lightfast for 200 years if kept in ideal conditions.
   However, all colour photographs will, in time, fade. This is particularly true if they are left in bright sunlight and are not behind glass. Island Photographic Services cannot accept any responsibility for this gradual image deterioration.

7. Prices
   All prices remain valid for 28 days.

8. Refunds
   Refunds will only be given in exceptional circumstances and solely at the discretion of Island Photographic Services. The customised nature of photographic goods means they are exempt from the "Consumer Protection (Distance Selling) Regulations 2000" Please review the following links if you are unsure or are not familier with these regulations Statutory Instrument 2000 No. 2334 | personalised goods or goods made to a consumer's specification.

9. General Liability
   Island Photographic Services cannot accept any contingent liability for any failure of any type resulting from the failure in any way of any product or service they supply.
